Rocker Goes With Boies In Overstock Case

Hedge fund Rocker Partners has rearmed with some high-profile legal firepower in its battle with online retailer Overstock.com.

New Jersey-based Rocker has hired David Boies’ Armonk, N.Y.-based Boies, Schiller & Flexner to defend it against a suit filed by Overstock, accusing the hedge fund of attempting to drive down Overstock’s share price.

Rocker made the move after a California appeals court denied its motion to dismiss Overstock’s suit last month. The hedge fund dumped Los Angeles firm Paul, Hastings, Janofsky & Walker to add Boies’ firm to its legal team, Gavin Rooney, another Rocker lawyer, told Bloomberg News.

Boies, perhaps best-known for representing then-Vice President Al Gore during the battle over 2000 presidential election, has also represented the U.S. Justice Dept. in its successful battle against Microsoft, the New York Yankees, Napster and Enron CFO Andrew Fastow.
