With massive redemptions, fund closures, and poor performance, Directors and Officers face a spectrum of heightened liabilities including litigation risks. What remedies do you have when the funds can no longer indemnify the directors or officers? How do you manage your fiduciary responsibility to protect the assets that remain? What risks do you face when halting redemptions and winding down the fund? How will you manage downsizing?
